Booking Conditions - Fairways Property Management Inc

After placing a reservation, you will be sent a confirmation email detailing the booking. You should check the details right away. These terms are binding in all cases unless you contact us within 48 hours of receiving your booking confirmation. We are not responsible for the booking of any flights, transport or other arrangements you may have made in addition to those services booked through us.

The person making the booking warrants that he/she has the authority of all persons included in the reservation to make the booking on their behalf. The person making the booking must also be 21 years of age or over. Proof of age may be asked for.

All clients outside the USA must be in a possession of a full 10 year passport. You must advise us if you do not have a British Citizens passport and if travelling to the USA you should familiarize yourself with US visa requirements. In particular if any of your party has any criminal conviction you may not be able to use the US Visa Waiver scheme and you must obtain up to date information as if your documents are not correct the airline may prevent you from boarding and Fairways Property Management Inc. Ltd. will have no further liability towards you.

Changes to your Booking

Occasionally we may be forced to make changes to your booking through reasons beyond our control. When any change affects your booking we will inform you as soon as possible, however most are minor and generally a change in villa specification will be an upgrade to that villa. If we must change your villa for any reason, we will do whatever we can to ensure it is of the same standard or better, offering the same facilities. If not, if we have to make a major change to your booking, i.e. moving your booking to a lower standard of villa, we will offer you the following options:

I. Accepting the change and a refund of price difference.
II. Cancelling and taking a full refund of all monies paid to us in respect of that booking.

Cancellation Policy

If you need to cancel or amend your booking you must contact us in writing as soon as possible. In addition to any charges imposed by the operator we will make the following charges to cover the additional administration involved: Amendment: $25 per person for amendments to existing bookings Should it become necessary for any member of your party to cancel the booking, this should be in writing and countersigned by the person initially making the booking. The cancellation will become effective from the date it is received in our office. Cancellations are subject to a charge detailed below as a percentage of the total amount due dependent on the time you cancel.

Cancellation notice given:

  • more than 56 days $75 administration fee
  • 56 days to 45 days 30%
  • 44 days to 30 days 50%
  • 29 days to 0 days 100%

Force Majeure

In the case of "force majeure" it may be necessary to terminate your booking before the scheduled conclusion of your booking. Such measures are very unlikely to occur, however, if the circumstances arise we will not be able to offer refunds, pay compensation, or reimburse you for any expenses you incur. We cannot be held responsible or accept liability where we are prevented from delivering our contractual obligations by "force majeure". These include, but are not limited to, war, threat of war, civil commotion or strife, hostilities, strikes and other industrial disputes, natural disaster, fire, acts of God, terrorist activities, technical difficulties with transportation, closure of ports or ferries, quarantine, epidemics, weather conditions, government action or other events outside our control. If you have some form of travel insurance it should cover you in some of these events.

Minimum Stay

The minimum stay is 3 nights. Please note that stays of less than 6 nights will incur an additional cleaning charge (please ask for current rates) to cover the cleaning of the villa at the end of your stay.

Checking In and Out

The villa will be available for your occupancy at 4 p.m. on the first day of your confirmed rental period, and you must vacate the villa not later than 10 a.m. on the last day of your confirmed rental period. An additional charge will be added in the event that we are unable to access the property after departure date.

Florida Law states that you must check in with our local office within 24 hours of your arrival (or first thing Monday morning if you arrive late on Friday or on Saturday). A map showing directions to our office will be in your villa on arrival.

Payment Terms

A non-refundable 10% deposit is required to secure all reservations at time of booking. Final payment for accommodation is due no later than 60 days prior to arrival date. If, for any reason payment is not received by this time, the booking will be subject to cancellation. If it is cancelled for non-payment there will be no deposit refund due.

Security Deposit

Most of our reservations include a damage waiver fee which will cover you for up to $750 of accidental damages. You must report the damages before departure, and they must be deemed accidental by Fairways. Upon arrival, all guests are required to register at Fairways Office. At this time, we will take the details of a major credit card as security against damages not covered by the waiver, negligence or additional charges. If you do not have a major credit card, a cash deposit of $1000 will be payable and refunded to you within 7 days after departure, in the event of a satisfactory departure inspection.

Damage Policy

The Guest acknowledges the authority of Fairways to charge the Guest's credit card for damages to the property occupied by the card holder and his/her respective Guest(s). Each Guest will be financially responsible for damage done to the property beyond normal wear and tear. If there is damage to, or missing items from, the property after the Guest's departure, the Guest(s) will be notified of any excessive cleaning needed, missing items, or damages made and a charge above and beyond the normal rate will be charged to the credit card on file (or such credit card otherwise identified herein). This is accepted as part of the rental agreement and is not subject to change or negotiation.

Costs of Enforcement of this Agreement

In the event of any dispute between the parties to this Agreement, the prevailing party in such action shall recover from the non-prevailing party it's attorney's fees, paralegal fees, investigative fees, costs and interest through all appeals, bankruptcy, and collection efforts.

Governing Law and Jurisdiction

TThis agreement is governed by, and is to be construed and enforced in accordance with, the laws of the State of Florida, without giving effect to the principles of comity or conflicts of laws thereof. Should litigation be commenced by either Fairways or the Guest, these parties must commence such litigation in the federal or state courts with jurisdiction in Orange County, Florida. Each party consents to the exclusive jurisdiction and venue within the federal and state courts with jurisdiction in Orange County, Florida, for a resolution of all disputes arising out of the construction, interpretation, or enforcement of any term or provision within this agreement, and each party hereby waives the claim or defence that any such court in which any such litigation is properly commenced as provided for herein constitutes an inconvenient forum.

Swimming Pool Heating

If you have ordered and paid for pool heating, this will be switched on ready for your arrival. Please note that pools take between 24 and 48 hours to heat depending on the time of year and whether the previous guest had ordered pool heating. Please note, pool heating is not guaranteed if you have not booked it at the same time as booking your villa. In cold weather electric pool heaters may not function as efficiently as a gas heater since they work on a heat exchange system. IF THE OUTDOOR TEMPERATURE DROPS BELOW 55 DEGREES THE ELECTRIC POOL HEATER WILL SHUT OFF AND WILL NOT COME ON AGAIN UNTIL THE AIR TEMPERATURE RISES. This is a safety feature and may not be overridden. The pool heater is designed to take the chilliness off the water temperature, not to make the water reach bath temperature. Please inquire about current weather conditions before ordering pool heating. The pool heater runs off the pool pump. This pump is on between 8 and 10 hours each day and will shut off automatically. Some pools have pool blankets available (a large piece of blue or clear plastic). Place this over the pool at night to retain most of the heat generated. In the morning, remove the blanket and place it neatly in the corner inside the pool screen. Please do not leave the cover outside the screen enclosure. Please note, these blankets are purchased by home owners and may not be available in all homes. Fairways does not have pool blankets to rent. Please do not adjust the pool pump, timer, heater, turn levers or push buttons on any pool equipment. You will be solely responsible for any damages and faults. If you experience any issues with the pool heater, please contact our office immediately to report the problem. Reports/complaints received after your stay will not be entertained.

General

Parents must, at all times, supervise children when using pool facilities and the facilities of the development. Fairways Property Management Inc, its agents or homeowners accept no responsibility or liability for failure of equipment in the rental property. After notification of equipment failure, Fairways Property Management will rectify the problem in a reasonable and timely manner.

We operate a strict "no pets" policy and it is against the law to smoke in any of the villas. Any pets or smoking in the villa will lead to a fine of $300 and immediate eviction with no refund of monies paid.

The property is privately owned. As we act merely as a booking agent for the operator, we can accept no responsibility for any injury illness or death or other loss caused unless as a result of our proven negligence or that of our employees acting in the course of their business.

The owners/management company reserves the right to enter the property at any time.

Whist it is unlikely that you should have any complaint concerning your booking, things do occasionally go wrong. In case of complaint you must contact our office immediately so the matter can be rectified as soon as possible. If you are not satisfied with the solution please make this known in writing to our office. We will not accept liability for any dissatisfaction or other complaints not reported to our office during your stay.

Fairways does not accept any liability for the acts of omissions of any agent. These include, but are not limited to, airlines, car hire companies, travel agents, ticket agents, homeowners, or utility providers.

In the event of any breakages, losses, or damages to the villa and its contents during your stay, you will be responsible for the cost of replacements and/or repairs not covered by your damage waiver.

Due to Florida State fire regulations, the maximum occupancy of the villa stated in our information and/or our website must not be exceeded.

Florida is a rapidly expanding growth State, and therefore construction may occur in or around the development in which your home is located. Fairways Property Management has no control over this, and accepts no liability for any inconvenience or disturbance that may be caused by such construction.

If your villa is in a gated community with security at the entrance, please show your booking confirmation letter to the guard and you will be issued with a pass which you will need to display for the duration of your stay.

This agreement is governed by the laws of the State of Florida and the United States without reference to conflicts of laws.
